The process involved in applying for a patent can be lengthy and confusing, especially for first-time applicants. In order to simplify the explanation of the overall process, it is helpful to break the process into three separate stages. These stages include:
- The search stage during which your invention is researched to ascertain potential patentability
- The application preparation stage during which your invention is documented within a technical description with drawings
- The application prosecution stage during which your written patent application is filed in a government office and negotiations with a government official ideally results in their granting you a patent
While the basics of the patent process are outlined above, it can be much less straightforward at times. Considering the importance of every step and the costs involved, this is not a process that should be taken lightly. Indeed, thinking up the idea might begin to feel like the easy part. Inventing, patenting, and subsequently commercializing your patented invention is a lot of work. However, if done right, it can be one of the most satisfying and rewarding things you can do.
